i had a penalty for 3 years that ran out in 2008 but when i look for insurance they ask for any penalty for the past 5 years. Do i say yes even though it expired in 2008?"

Yes, you must. If you do not declare it they will find out if you have to make a claim in the next year. And you will render yourself uninsured by failing to disclose. Now, I am not a blue - eyed boy and the day was where I would have risked it - but everything's computerised now and it takes them a mere second or two to look up your entire driving history - old insurance details, MoT's to cars in your possession, driving record. it's just silly to take any risk. What happens if you kill someone in an own - fault accident? No insurance? Â£1m claim value? You're screwed for life for the sake of trying to avoid a 'possible' loading of 10% on your insurance premium. In fact, if it was only a 3 year endorsement 3 points?, then there would be no loading whatsoever. Get the idea out of your head - it's not worth it. And I will tell you something else they do - they 'rely' upon you supplying correct information when they take your money. They do not check any details. When the claim comes, however, they run a fine - toothed comb through everything; looking for that tiny detail that renders your insurance void. They will only find out when they go looking
You tell them everything the ask for as they are interested only in what has happened in the last 5 years regardless of what has expired. The normally ask for the offence code, date of offence fine and ban if any - all of that will remain on your licence until at least 4 years from the date you committed the offence. Whilst it is expired in terms of the DVLA totting up procedure if you fail to tell your insurer then they can make the insurance invalid in the event of a claim. When a claim is made they will want to see the licence
